It is issued to the companies or individuals to exempt the applicants from double taxation. In UAE such a certificate is issued by Ministry of Finance (MoF). An assessee, not being resident in a country, shall obtain UAE Tax Residency Certificate for Individuals and Companies from the Government of the Country or the specified territory of the Assessee claims to be resident, which shall contain the following particulars:

  1. Name of the Assessee
  2. Status of the assessee (individual, company, firm etc.)
  3. Nationality
  4. Company or specified territory of incorporation or registration
  5. Assessee’s Tax Identification Number
  6. Residential status for the purpose of Tax
  7. Period for which the certificate is Applicable
  8. Address of the applicant for the period for which the certificate is applicable

Procedures for Obtaining Tax Residency Certificate :

Step 1: Sign Up

The user should create his or her own account with Federal Tax Authority under the following link https://trc.tax.gov.ae/TRC_Th/SignUpScreen.aspx. The user has to create an account for self by providing the required details such as:

  • Email id
  • Name
  • Username
  • Country Code
  • Address
  • PO Box
  • Password required by the User (password should satisfy the conditions as specified)
  • Security Code
  • Answer and hint for the same

Step 2: Login

The user will be redirected to the page https://trc.tax.gov.ae/TRC_Th. The user has to login to his account using the Username and password created by the user.

Step 3. User Main Page Dashboard:

  • User can create new Tax Certificate Request
  • Complete the Application form
  • Attach the required documents in the formats specified
  • Those documents will be verified, if they expect to meet the requisite standards the user will receive an email confirmation
  • After receiving this confirmation, the user has to pay the required fees.
  • After payment confirmation, the user will receive the certificate through express courier.

This Certificate is used to fully utilize the advantages of the extensive double tax treaties and to take advantage of double taxation avoidance agreements signed by UAE with over 76 countries in the World and this Certificate valid from one year from the date of issue.

This official Tax Residency Certificate in UAE is not applicable to Offshore Companies (International Business Companies)

TAX RESIDENCY CERTIFICATE (COMPANIES):

Offshore companies are ineligible from and this. Such companies can apply for a tax exemption certificate

For companies operating in the region and have completed more than one year in its business operations can apply for the Tax Residency Certificate with the following specified documents:

  • Valid Company Trade License Copy
  • Establishment contract certified by official authorities (if it is not a sole company)
  • Shareholders & Managers passport Copy
  • Shareholders & Managers Residence Visa
  • Shareholders & Managers Emirates ID
  • Certified copy of the latest audited Financial Statement/ Audit Report
  • Latest and validated Company bank statement for six months
  • Certified copy of Company Lease Agreement or tenancy contract
  • Tax Forms (if any) from the Country in which the certificate is to be submitted

TAX RESIDENCY CERTIFICATE (INDIVIDUALS):

As well as Companies Individuals can apply for tax residency Certificate, if they have completed at least 180 days of stay in UAE. This can help individuals from avoiding double taxation in their native countries.

  • Passport Copy
  • UAE Residence Visa Copy
  • Emirates ID Copy
  • A Certified copy of (residential) lease agreement or Tenancy Contract Copy
  • Latest Salary Certificate
  • Latest and validated Company bank statement for six months
  • A report from General Directorate of Residency and Foreigners Affairs specifying the number of days resident has stayed in UAE
  • Tax Forms (if any) from the Country in which the Certificate is to be submitted.
